General Terms and Conditions
Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:

Trader: the natural person who offers products to consumers via the webshop at a distance.

Consumer: the natural person who is not acting for purposes related to his trade, business, or profession.

Distance contract: an agreement concluded between the trader and the consumer within the framework of an organized system for distance selling of products.

Right of withdrawal: the consumer’s right to cancel the contract within 14 days.

Day: calendar day.

Durable medium: any tool that enables the consumer or trader to store information for future use (e.g. email).

Article 3 – Applicability
These Terms and Conditions apply to every offer from the trader and every distance contract concluded between the trader and the consumer.
Article 4 – The offer
If an offer has a limited validity or is subject to conditions, this will be explicitly stated.
The offer includes a complete and accurate description of the products. Images are a true representation of the products. Obvious errors do not bind the trader.
Article 5 – The contract
The contract is concluded at the moment the consumer accepts the offer and meets the stated conditions.
If the contract is concluded electronically, the trader will take appropriate technical and organizational measures to secure data transfer and provide a safe web environment.
Article 6 – Right of withdrawal
The consumer may cancel the purchase within 14 days without giving reasons.
The period starts on the day after the consumer, or a third party designated by the consumer, receives the product.
Exceptions:
Opened or used products falling under food or personal care (such as olive oil or soap) cannot be returned for hygiene and safety reasons.
Unopened products may be returned within the 14-day period.
Article 7 – Consumer obligations during the withdrawal period
The consumer must handle the product and packaging carefully. He may only unpack or use the product as necessary to assess its nature and characteristics.
The consumer is liable for any reduction in value resulting from improper handling.
Article 8 – Costs in case of withdrawal
If the consumer makes use of the right of withdrawal, the return shipping costs are borne by the consumer.
If payment has already been made, the trader will refund the amount within 14 days after receipt of the returned product, minus the original shipping costs charged by the trader, unless the error was on the trader’s side.
Article 9 – Exclusion of the right of withdrawal
The trader can exclude the right of withdrawal for:

Products that perish quickly or have a limited shelf life.

Sealed products that are not suitable for return for health or hygiene reasons and whose seal has been broken after delivery.
Article 10 – Price
Prices will not be increased during the validity of the offer, except for changes in VAT or other legal requirements.
All prices include VAT.
Article 11 – Delivery and execution
The trader will take the greatest possible care when processing and delivering orders.
The place of delivery is the address provided by the consumer.
Orders will be executed within 30 days, unless a longer term has been agreed.
Article 12 – Payment
The consumer must pay the amounts due during the order process.
Accepted payment methods are clearly indicated on the website (e.g. PayPal, credit card, iDEAL, Bancontact).
Article 13 – Complaints
Complaints about the execution of the contract must be submitted clearly and fully to the trader via ciao@olivatranquilla.com within a reasonable time.
The trader will respond within 14 days of receipt.
Article 14 – Disputes
Contracts between the trader and the consumer to which these Terms and Conditions apply are governed by Italian law.
Mandatory consumer rights from the consumer’s country of residence (e.g. Belgium or the Netherlands) remain unaffected.
Article 15 – Additional provisions
Additional or deviating provisions must not be to the consumer’s detriment and must be recorded in writing or on a durable medium.
